1. Scope of Application


These General Terms and Conditions (GTC) apply to all contracts concluded between the customer (hereinafter referred to as the "Guest") and the agency Dalmatienhaus in the context of the mediation of holiday accommodations in Croatia.

Dalmatienhaus acts as an intermediary of accommodations in Croatia. The rental agreement is concluded in the name and on behalf of the respective property owner.

Dalmatienhaus is not the landlord, but solely the agent of the contractual relationship.



2. Contractual Relationship


A binding rental agreement is concluded between the guest and Dalmatienhaus upon booking.

Dalmatienhaus acts on behalf of and with the authorization of the accommodation owners.



3. Booking and Conclusion of Contract


Bookings can be made online via the Dalmatienhaus website or by e-mail.

By completing the booking, the guest accepts these General Terms and Conditions.

The rental agreement becomes effective upon confirmation of the booking by Dalmatienhaus.

Note: For bookings made through partner platforms, only the terms and cancellation conditions of the respective portal apply.



4. Payment Terms


After receiving the booking confirmation, a deposit of 30% of the total amount is due within 3 days.

Payment can be made by bank transfer, credit card, or PayPal.

The remaining balance must be paid no later than 30 days before arrival.

If the booking is made within 30 days of arrival, the full amount is due immediately.

If a selected payment method is unavailable, a suitable alternative will be offered.

Without full payment, there is no entitlement to the accommodation.

The tourist tax (if not included in the total price) must be paid separately on-site. The amount is based on the applicable municipal regulations and must be paid by the guest.



5. Cancellation by the Guest


The guest may cancel the booking at any time. Cancellation must be made in writing.

The following cancellation fees apply:

  • Up to 60 days before arrival: 30% of the total price
  • Up to 30 days before arrival: 50% of the total price
  • Up to 7 days before arrival: 80% of the total price
  • From 6 days before arrival or in case of no-show: 100% of the total price

We strongly recommend taking out travel cancellation insurance.



6. Arrival and Departure


Check-in on the day of arrival is possible as follows:

  • Apartments: from 3:00 PM
  • Holiday homes / villas: from 4:00 PM

Check-out must be completed by 10:00 AM on the day of departure.

Early check-in or late check-out is only possible by prior arrangement and subject to availability.

Late arrival or early departure does not entitle the guest to a refund.



7. Use of the Accommodation


The accommodation may only be used by the booked guests and exclusively for holiday purposes.

Pets are only allowed with prior written consent.

The house rules are part of the rental agreement and must be followed by all guests. They are available in the accommodation or will be provided via e-mail in advance.



8. Conduct in the Accommodation


The guest agrees to treat the property and its inventory with care.

Parties, excessive noise, loud music, and unauthorized visitors are strictly prohibited.

Local rules for waste separation and disposal must be observed.

In case of serious violations, the agency reserves the right to terminate the contract immediately.



9. Deposit and Damages


For certain accommodations, a security deposit may be required, payable in cash upon arrival or by bank transfer in advance.

The deposit will be refunded within 7 days after departure, provided the accommodation is returned in proper condition.

The guest is liable for all damages or losses caused during the stay.

Missing or damaged items will be charged at replacement value.



10. Liability


Dalmatienhaus is liable only in cases of intent or gross negligence.

No liability is accepted for indirect damages (e.g. loss of profit).

The guest is liable for all damages caused by themselves or accompanying persons.



11. Defects and Complaints


Any defects must be reported to the agency immediately so that corrective action can be taken.

Complaints made after departure cannot be considered.

Statutory warranty rights remain unaffected.



12. Data Protection


Personal data will only be processed for the purpose of handling the booking (e.g. contact, payment, guest registration) and will not be shared with third parties unless required by law (e.g. with authorities) or necessary for fulfilling the contract (e.g. with the accommodation owner).

13. Final Provisions


The law of the Republic of Croatia shall apply.

Place of jurisdiction – as far as legally permissible – is the registered office of Dalmatienhaus. The competent court is Zadar, Croatia.

Any changes or additions must be made in writing.

Should any provision of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected.



14. Force Majeure


If the performance of the contract becomes impossible due to unforeseen events beyond the control of Dalmatienhaus (e.g. natural disasters, pandemics, border closures), the guest shall have no claim to compensation.

Payments already made will be refunded or credited for a rebooking wherever possible.
